Another case against Napster

Now EMusic sues Napster, because of copyright infringement. The company also sued Napster for 'unfair' competition.



For over six months, Napster has flatly rejected our requests to filter out and effectively block EMusic tracks from being traded on their system without our permission,'' Gene Hoffman, EMusic chief executive, said on Wednesday.

In a last-ditch effort to avoid being shut down, Napster this past weekend finally began to block users from several hundred copyrighted songs, but with only limited success as Napster fans figured out ways to get around the screening mechanism.

Napster is working to improve the system, it said.

Emusic said Napster's ability to implement such a system over the weekend after months of saying it could not showed that Napster's true motive was to unfairly build a business upon the copyrighted works of others.

We welcome the injunction that the court has issued against Napster. It is a major step toward leveling the playing field for legitimate downloadable music companies,'' Hoffman said.
